1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Fitness Quest - With My Pet mobile application and website, published by Adex Soft Studio ("Adex Soft", "we", "us", or "our"). By downloading, installing, or accessing Fitness Quest, you agree to be bound by these Terms. If you do not agree, do not use the application.

3. Virtual Companion Mechanics & In-Game Assets

Virtual companions (including Milo the dog, Cat, Fish, Lion, Deer, Llama, Elephant, and future species), habitats, food bowls, care points, streaks, and memorial stones are simulated digital gameplay elements:

• Virtual companions and care points have no monetary or cash redemption value.
• They cannot be sold, transferred, or exchanged outside the sanctioned in-app Voluntary Handover mechanism.
• Adex Soft reserves the right to rebalance or adjust care point formulas, companion species attributes, and game mechanics to ensure fair and safe habit motivation.

4. Subscriptions, Free Trials & Store Billing

Fitness Quest provides a free starter tier (including Milo the dog, Cat, and Fish) and an optional premium subscription known as Fitness Quest+:

• Plans & Free Trials: Fitness Quest+ is offered in two auto-renewing cadences: Monthly at $3.99 per month, and Yearly at $23.99 per year ($1.99/mo, 50% savings). Both plans include an introductory 3-day free trial. Your trial will automatically convert to the chosen paid recurring subscription unless canceled at least 24 hours prior to the conclusion of the 3-day trial period.
• Store Billing: All billing, invoicing, payments, and cancellations are executed directly through the Apple App Store (Apple Media Services) or Google Play (Google LLC). Adex Soft does not process or retain your payment card details.
• Cancellations: You may cancel auto-renewal at any time via your iOS App Store or Google Play account settings. Upon cancellation, your Plus benefits remain active until the end of your current paid billing period, after which your account reverts cleanly to the standard free companion tier without losing your pet's historical data.

5. Acceptable Use & Community Conduct

When participating in the Little Circle (Friends) and using shared invite codes:

• You agree not to choose offensive, defamatory, or abusive pet nicknames or display names.
• You agree not to use automated bots, emulator scripts, or simulated GPS spoofers to manipulate care point totals.
• We provide built-in Block User and Report Abuse tools. Adex Soft maintains zero tolerance for harassment and reserves the right to immediately terminate accounts violating community standards.

6. Intellectual Property Rights

All visual artwork, character designs (including Milo, Cat, Fish, Deer, Llama, Lion, and Elephant), animations, soundscapes, source code, UI designs, and brand trademarks associated with Fitness Quest are the exclusive intellectual property of Adex Soft Studio and are protected under international copyright and trademark laws. You may not copy, reverse engineer, decompile, or redistribute any asset without express written consent.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Adex Soft Studio and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or inability to use the service, or any physical injury arising from physical exercise undertaken while playing.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws applicable to Adex Soft Studio, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of competent jurisdiction.
